Terms of Use

These Terms of Use (the "Terms") govern your access to and use of the Spectro#3767 (Discord User ID: 1310159012234264617) bot—hereafter referred to as the "Bot"—and any related services provided by the Bot's maintainers (the "Service"). By accessing or using the Service, you ("User") agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.

Definitions

Open Source & Self-Hosting

The Software is open source under the AGPL-3.0 license. You may self-host your own instance subject to that license. These Terms govern only the hosted Service operated by the maintainers—not self-hosted instances.

Service Description

The Bot enables Discord server members to post anonymous confessions and replies in moderator-configured channels. For moderation and safety, all confessions are logged and may be reviewed by server moderators. For a detailed overview of features and usage, see the User Guide and Command Reference.

Eligibility & User Obligations

  • You must be at least 13 years of age (or the minimum age required in your jurisdiction to use Discord) to use the Service.
  • You must comply with all applicable Discord Terms of Service and Community Guidelines.
  • You must not use the Service for any unlawful, abusive, or malicious purpose, including but not limited to harassment, hate speech, threats of violence, or the sharing of illegal content.
  • Content depicting child sexual abuse material (CSAM) is strictly prohibited and will be reported to the appropriate authorities.
  • "Doxxing" or publishing others' private information (e.g., addresses, phone numbers, real names) without their consent is prohibited.
  • You are responsible for any content you submit via the Bot. Confessions and replies must comply with your server's rules and all applicable laws.
  • Server moderators are responsible for configuring the Bot appropriately and for moderating content as described in the setup instructions and moderation documentation.

Data Collection & Privacy

The Bot collects and logs certain data to provide its functionality and for moderation purposes. Details on what data is collected, how it is used, and your rights regarding your data are described in our Privacy Policy.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

  • We do not guarantee uninterrupted, error-free, or secure operation of the Service.
  • We are not responsible for the actions of Discord, server moderators, or other users.
  • Anonymity is limited to regular server members; moderators and maintainers may access logs.
  • We may modify, suspend, or discontinue the Service at any time without notice or liability.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE MAINTAINERS OF THE BOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; OR (C) ANY OTHER MATTER RELATING TO THE SERVICE.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE, OR (B) ONE HUNDRED PHILIPPINE PESOS (₱100).

Termination

We reserve the right to terminate or suspend your access to the Service at any time, at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is otherwise harmful to the Service or other users.

Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via the website or the Bot. By continuing to use the Service after changes become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

Indemnification

You agree to indemnify and hold harmless the maintainers from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or content you submit through the Bot.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Juan City, Metro Manila, Philippines.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the maintainers regarding the Service, superseding any prior agreements.

No Waiver

Failure to enforce any provision of these Terms shall not constitute a waiver of that provision or the right to enforce it later.
